If he is charged with a felony, it won't make it to a jury trials the wisest course of action for the defendant would be to plea out to a misdemeanor charge if offered by the prosecutor.

However, the prosecutor may not offer a plea deal option if the government wants to make an example of the defendant.[/quote]
