Because the judge already indicated he’s not inclined to grant it. Gottlieb asked about it at the last hearing and the judge was skeptical and said the case was not dismissed on the basis of 47.1. I read it as a face saving concession to Blake for dismissing her claims with prejudice and with no money exchanging hands. So now she can say she’s still fighting the good fight. But actually she’s only dragging this out until another bad PR day when the judge denies it.[/quote]

DP and this is my take on it as a litigator as well. Further, the statute requires an evidentiary hearing that has not and now will not occur because her case was dismissed with prejudice.  I don't think Liman will wait long to rule.[/quote]
