Dearie is taking the view, along with other radical views like water is wet, that documents marked with proper government classification are in fact classified. So the burden of proof is going to be on Trump to prove he declassified them, and how, when, where, etc. So either Trump submits a sworn declaration (under penalty of perjury) and/or he gets others to swear under oath that they witnessed the declassification. If the lawyers know these people are lying, as they clearly would be, then submitting their statements under oath with be suborning perjury, which is a big no no.[/quote]
