Won't ODNI need information/evidence from DOJ about who might have handled or had access to the documents while they were at Mar-a-Lago in order to evaluate the extent of any harm to national security? How is ODNI going to get that information if they cannot discuss the documents with DOJ?
To this point, can ODNI intervene somehow to seek clarification of the order or request reconsideration? It seems like the most effective way to get the court to reconsider this moronic decision is if ODNI points out that it cannot carry out a critical national security risk assessment without being able to talk to DOJ about these documents and the related investigation.
The US is already a party. DOJ represents the US government and imicutly represents ODNI as a stakeholder. In this case the National Security Division of DOJ is running the show.
But the judge thinks that DOJ is not part of the executive branch otherwise how can there be executive privilege?
The ruling is absurdly illogical and incoherent.

Trump will grant him the clearances, the judge will approve it and DOJ will fall in line. Yeah Trump is not president and he does not have the power to do that but as long as the judge goes along with it…after this is it really a bridge too far?
We are way past law and order. Wait till November. The courts are packed with republicans judges. It is going to be ugly and shockingly open.

If I'm ODNI I'm not even thinking about darkening that courtroom with my shadow.
I believe DNI is making their assessment under an analytical framework that assumes the classified materials were released into the public domain. They can spin off every other theory from there.
