You seem to forget that Executive Orders are limited to the constraints that Congress already has on the Executive.  The President isn't actually "going around Congress" when he passes an EO like this.  An EO is purely a function of how executive agencies implement existing policy, within the parameters of existing laws already passed by Congress.  Obama is proposing making EXISTING background checks more rigorous where it comes to high volume gun sales.  The authority to do background checks is a power he already has.[/quote]
