Perhaps you could also argue that the fact that the contract refers to your initial money as a "deposit" is an implicit recognition that you are not yet bound to pay the full amount. Contracts are construed against the drafter, so any ambiguity should work in your favor. Good luck to you. I have a litigation background so I tend to be more risk-averse in some ways, and see the downsides of various situations, including threatening litigation. Somewhat counter-intuitive I know!
