They can, but it's not without risks.  Our nonprofit daycare/preschool has been through the ringer the last two years and is only barely still financially solvent- do places like this really want to risk a lawsuit?  Our center has had one positive case this entire time- so requiring the vaccine now under EUA doesn't seem worth it.

+1 l- we have stuck with our child’s preschool throughout the pandemic even as they have closed for extended periods (of course while still charging us) and reduced coverage hours while raising rates. We have also put up with the theater of forcing our 3/4 year old to wear a mask- (which comes back disgusting/germ laden each day, has limited her speech development, and hasn’t prevented (may even have contributed to) her contracting at least a half dozen separate colds/bugs) for over a year and a half now. I do plan to vaccinate her when/soon after she turns 5, but on a schedule that works for us, and honestly if her preschool demanded proof/tried to force us to immediately do so while it is still under EUA it would be the last straw and I would pull her from the program.[/quote]
