So there WAS a threat. He should go to jail.
What threat? Asking want to fight is not a threat that does or should get someone jailed. Referencing Hiroshima is absurd and offensive, but again not a threat to her.
Subjective. May not seem like a threat to you but to her could have been interpreted as such. Up to the authorities to make the determination as to whether it was/wasn't a threat not but your opinion is noted.
Yes, but there has to be an actual law that is broken. Someone feeling threatened does not mean a crime has occurred. Md. Crim. Code 3-1001 has a provision that arguably would apply, but it seems to need more than five people to be threatened. There may be a similar provision where that wouldn't be needed. But, even ignoring the five people requirement, I'm not sure that what occurred would violate it. And it would certainly be a very difficult criminal case to bring given the burden of proof. https://codes.findlaw.com/md/criminal-law/md-code-crim-law-sect-3-1001.html c) A person may not knowingly threaten to commit or threaten to cause to be committed a crime of violence, as defined in § 14-101 of this article, that would place others at substantial risk of death or serious physical injury, as defined in § 3-201 of this title, if as a result of the threat, regardless of whether the threat is carried out, five or more people are: (1) placed in reasonable fear that the crime will be committed; (2) evacuated from a dwelling, storehouse, or public place; (3) required to move to a designated area within a dwelling, storehouse, or public place; or (4) required to remain in a designated safe area within a dwelling, storehouse, or public place.
At least 5 people thought he was going to try to fight her... especially the dude the stepped in to stop him.
