Rather, the law imposes obligations on certain types of entities (called covered entities and business associates). Basically, you have to be a healthcare provider, pharmacy, insurance carrier, or an entity that is working under contract on behalf of those entities. In other words, HIPAA does not say "All medical information must be kept private." Instead, it says something to the effect of "Covered entities and business associates must do XYZ to keep your information private/secure..." So unless the school was employing a third-party medical provider to collect this information, it would not be covered by HIPAA. FERPA, on the other hand, might prevent its disclosure.[/quote]
