This drives me nuts. The protections of HIPAA don't attach to medical information itself. Rather, the law imposes obligations on certain types of entities (called covered entities and business associates). Basically, you have to be a healthcare provider, pharmacy, insurance carrier, or an entity that is working under contract on behalf of those entities. In other words, HIPAA does not say "All medical information must be kept private." Instead, it says something to the effect of "Covered entities and business associates must do XYZ to keep your information private/secure..." So unless the school was employing a third-party medical provider to collect this information, it would not be covered by HIPAA.

FERPA, on the other hand, might prevent its disclosure.

A teacher weighed students in my child's kindergarten class last year at Shepherd ES in front of everyone. I was surprised and my ds let me know who weighed what.

Just to be clear: The OP read a Facebook post and extrapolated that it happened at Deal. There has still not been a single first-hand report on this thread validating that a Deal PE teacher has publicly weighed students and announced their weights.

We do, however, have a couple of Deal parents reporting that children are weighed privately in PE and that it's possible the kids talk about their weights. It would be reasonable to suggest that even this isn't appropriate/necessary, and that it puts kids in the position of being peer-pressured into discussing their weights. I would agree with that position!

But the entire premise of the original post--what's generating all of the outrage--is an unconfirmed, third-hand report that the PE teacher at an unnamed middle school that might be Deal is publicly shaming kids about their weight. And it seems not to be backed up by a single poster on this thread. So maybe let's not freak out?

It is PE. They cover health and fitness as well. They will exercise daily and see what changes occur.

This was common practice in my Eastern European School, once upon a time. We all had yearly physical exams and lined up. Of course, there was no obesity epidemic and nobody cared either way. Since I didn't think there were these kind of group physicals here in schools, I wonder what was the purpose of this weigh in?

People who say this is no big deal obviously never had weight problems. I was overweight in middle school and already had self esteem issues. Changing for gym class was the worst part of my day. Being weighed in front of other students would have been horrific. I was teased enough without everyone knowing my weight. And this was at a Montgomery County school people on the Md school board love.


Still not something for which a teacher should be fired.

Kids weighted in line, you got on the scale, and the nurse wrote down the number quietly. Maybe you could see the weight of the kid in front of you in line. It's not like the school nurse announced. "Larla Jones, 78 pounds" at the top of her lungs.
