So, he lied about his friends and then tried to cover that up by claiming he was "speculating?"  
Things get real for sure.  So, instead of admitting that he sent the texts and knew about the relationship well before March, 2022, he said, "he could not recall" or claimed to be "speculating."

This was supposed to be Merchant's best defense for her guilty guilty client, to disqualify the DA.  But she was never going to be able to make it happen.  There was never a conflict of interest.
