Team OP, but I can see how the latter would cause more animosity especially against a small dog who did no lasting damage. (Not defending the dog and my dogs are all big who would never bite; I know the smaller ones are dicks, but if you kicked the thing like it was a football in the Super Bowl enough to kill it I can see that being perceived as an overreaction).
