If six people apply for one job, and two of them are minorities, and the employer ends up hiring his best buddy from high school (who happens to be white), that leaves five applicants who may or may not have been as qualified out of a job…..because of cronyism. [/quote] DP. This is why the disparate impact angle noted previously is important. A plaintiff at not be able to proved a racist intent in any particular hiring decision (ie, disparate treatment), but with enough data over a long enough period of time showing a clear pattern of racial minorities being consistently denied opportunities in favor of white men can prove disparate impact, which is also actionable.[/quote]
