Cases settle all the time, for all kinds of reasons, mostly related to cost and publicity. Second, the court of appeals opinion suggests that Sidwell did meet its obligation with regard to the grades issue. Not sure because I haven't read the whole thing, but I suspect the school agreed to review the grades, and did, but that their review didn't give the result that the student and her parents expected.
