No way on earth anyone's going to *prison*, they may get a night in jail, but prison?!?

And I HIGHLY doubt the perv would press charges anyway, as that would lead to him having to hand over his cell phone as evidence during the discovery phase, and something tells me that Mr. Looky Loo wouldn't want ANYONE,  but especially the police seeing ccx what's on that phone.

Remember, it's all too easy for prosecutors to subpoena cell carriers, and no matter if the guy deletes the evidence or smashes his phone, that evidence is stored with the carrier forever.

So, something tells me there'd certainly wouldn't be any prison time (lol) but no jail time either... well, maybe for the stupid perv IF anyone.
