I think they should get a fair trial, and, if appropriate, a fair hanging. As a practical matter, I don’t think there is much if any chance that these guys won’t be convicted of some flavor of criminal homicide, as IMO they should be based on what I know about the case so far. It will significantly affect the case though—it basically takes first degree murder off the table, since I don’t think a procsecutor will be able to prove beyond a reasonable doubt that it was premeditated. The defense will be able to plausibly argue it was just a citizens arrest gone bad. That also puts negligent homicide on the table, although I doubt they get off that easy. But there is now a real chance of a disposition like voluntary manslaughter, and that’s really going to piss a lot of people off. We’ll see, a lot depends on the details of state law. Second, a lot of the discussion is around the larger social meaning of this case, and IMO it’s totally different if you have a couple of yahoos intentionally killing for sport vs. stupidly confronting a burglar in a way that recklessly caused his death. They had no right to try to stop him, no right to do anything, and the idea that the jogger was supposed to stop because to hunyacks in a pick up truck commanded it is total BS.[/quote]
