The only instance is if he is not on the birth certificate. Is that the case? If so then you can't automatically get child support without going to court either.
Are you the OP? I'm trying to help you avoid an incredibly costly, multi-state custody and support battle.

Is that because a court has already affirmatively found that he has no right to legal or physical custody, or because the issue has never been in court? Because you're about to file asking for child support, which presumably will be based on the fact that he's the child's father. As the father, he may very well have a legal right to the child, and he might very well assert it--custody may not be in play now, but that can change. I highly recommend consulting a family law attorney.
