If you're talking about someone who committed a crime and is already in local or state custody, then you might have a point. But if you're talking about using state and local law enforcement to round up undocumented people the way ICE does--in workplaces, at Target or Home Depot, on the street because they "look" foreign, on the street where they pull cars over because they're been driven by someone who looks foreign, in parking lots, etc. etc. etc., that is not the job of local or state LEO. That is the job of BP and ICE--local/state LEO are not authorized to do that kind of work. Can you be specific about what types of "illegals" exactly you mean? [/quote] DP. You just parrot MAGA points but have you stopped to think about what you're saying? Immigration enforcement is a FEDERAL responsibility, not a local one. How do you propose that local cops 1) identify and 2) "capture" these folks? There a number categories of people who may be in this country without proper documentation. *visa overstays (they're not always POC--they can be white and from Europe or Canada) *"border crossers" who did not go through passport control at the border (how do you find them since they're not officially here?) *visa violators (other than overstays)--for example, people who enter legally but are working without authorization on a non-work visa. *people with temporary protections who lose status--e.g., initially allowed entry under programs like humanitarian parole but who remain after protections end or are revoked And then there are the folks who are here perfectly legally but who may "look" or "sound"foreign: *green card holders *people on the following visas: Tourists/business visitors (B-1/B-2 visas), Students (F-1 academic or M-1 vocational), Temporary workers (e.g., H-1B specialty occupations, H-2A/H-2B seasonal, L-1 intracompany transfers, O-1 extraordinary ability), Exchange visitors (J-1), Treaty traders/investors (E-1/E-2) *protected status holder such as refugees *asylees (granted asylum) *Temporary Protected Status (TPS) recipients *parolees (humanitarian or other parole) *victims of trafficking (T visa) or crime (U visa) Local cops are not tasked with ascertaining whether someone is here legally and then arresting them if they're not.
