That would be true if it is a medical condition such as this.  But if a kid was shooting up in the bathroom, that's an entirely different matter.  It's a separate issue from a 'medical emergency' though in this case the two coincided. [/quote]

Is the student being charged with a crime such as possession?  Are they being deemed a treat to public safety because of the drug use?  Is there evidence of a massive drug ring taking place inside of the school?  If not, then I feel like it still 100% falls under a medical condition that is afforded a certain level of protection and privacy due to HIPAA.  I do understand that there are some weird gray areas when it comes to schools and whether HIPAA and/or FERPA apply to these kinds of situations.
