[/quote] No. MD Transportation law says that the person entering the road (e.g. the other lady) is required to stop or yield the right of way to the vehicle already on the road in this situation. Since she was coming form the off-ramp and merging onto a new road, she had to yield the right of way to vehicles already on the road she was trying to merge onto. The lady violated the right of way and caused the accident. She has no legal grounds for the suit as she was the one violating moving traffic laws. She can file, but she will lose. The insurance company will subrogate for OP's daughter. They will likely also claim lawyer fees, so the lady will not only lose the lawsuit, but will likely have to pay legal fees for anyone who had to defend against the frivolous suit. [/quote]
