Either way, though, it's going nowhere. For him to prevail on getting schools to reopen, he would need to prove not only that the virtual schooling provided by APS does not qualify as "high quality," but that APS in fact cannot provide virtual schooling, in whatever form that meets the standard of "high quality." Otherwise, the appropriate remedy is simply to require that APS improve its virtual learning option to meet the constitutional standard for "high quality." The consequence of a ruling that virtual learning cannot qualify as "high quality" would be that Virtual Virginia would have to be complete shut down, and the Virginia courts aren't going to do that.[/quote]
