[/quote] No they don't [/quote] She can file and it can cause a lot of issues. Generally it is not considered, but sometimes. My husband's ex did that to us. However, it backfired as older kids got removed from the child support that should have been over and her alimony was terminated. They do look at new spouse income but it shouldn't be based on it. Mine was taken into consideration as it put him in a higher tax bracket. If he does a modification, it can cost him more in attorney fees vs. actual amount paid. He probably has zero time share and visitation is at will of Mom. [/quote]
