So if a male elementary school teacher is teaching a class of 1st graders and he has 2 years experience, and a female teacher is teaching a class of 1st graders and she has 20 years experience should they be paid exactly the same? I mean they are both teaching a class of first graders.
The man could argue that and win.
I bet if you read the nitty gritty parts of the law you’ll find an exception for pay structures that reward employees based on tenure or advanced degrees. So in the example above, all male and female teachers with 20 years of experience are paid the same, and are paid more than all male and female teachers with 2 years of experience.
