I mean technically yeah this could happen. The banking password wasn't complex and if they just went with the password that was the easiest and least complex to get then sure, they could have done it. But the prosecution doesn't actually have to make a case for that or even prove that. They just need to prove beyond a reasonable doubt that all the evidence shows that the person is guilty of the crime of which they are accused.  The defense would have had to make a much stronger case on this issue for me to be persuaded. Like there was a bust of a known ring of hackers who downloaded this kind of material and they were discovered to have been involved in such activities at the same time that the this happened on Josh's computer and so on.  I have to wonder if the defense tried to get better expert witnesses and just couldn't find anyone who was willing to testify under oath regarding alternate theories or if they found that most of the experts said yeah, he is pretty much the one who did this ...[/quote]
