The feeling is that people who truly believe they are in danger don’t go about business as usual - they take steps to protect themselves, even if it breaks rules. Since that didn’t happen, it raises questions as to whether the threat was as dire as is now argued. In court it isn’t what they knew after the decision but rather what was known when the decision was made. And the standard is gross negligence not simple negligence in this case.
