I can't believe you would not call Ashley off camera and say "tomorrow when we are filming and talk about the accident please don't mention me drinking."  I mean...legal consequences anyone???  I guess there is nothing they can do after the fact but I still wouldn't want it on camera about how I drove drunk home and ran into a tree. While I wouldn't have admitted it, the worst that will happen is her insurer contests the claim -- assuming she even filed a claim. There is no evidence to charge her with DUI as they would need the results of a sobriety test conducted at the time of the incident.

If she injured someone, they could sue her for damages but I'm not sure the courts wouild award differeintly based on her having a few drinks. Either way, damages are damages.
