What are they checking? Does everyone have to show if?
Yes everyone(not just the driver) has to show ID and proof of citizenship. A real ID is not proof of citizenship. You also have to give a reason why you are traveling- where you are going, who you are meeting, where you are coming from, address of employer, etc. They can impounded your car and take your phone if ICE or Customs and Border Protection (CBP).
So in DC now we have to travel with papers. We are truly in a Gestapo state.
If you’re driving a car, it’s not unreasonable to assume you’d have your drivers license, registration, and proof of insurance with you. What is unreasonable about that?
Have you heard of the 4th Amendment?
The PP said "if you are driving a car" and he/she is correct. You do have to provide DL, Registration and proof of insurance during a traffic stop. That has been long established and isn't subject to 4th amendment.
Oh yes it is. The 4th Amendment has not been stuck down yet.
Didn't say it was, but by law have to present a valid driver's license during a trafic stop if you are the one operating the vehicle. I'm shocked that anyone would think otherwise.
They are not asking for ID but proof of citizenship. They are also asking where are you coming from, where are you going, why are you going there, party registration, etc. They will take any firearms in the vehicle and arrest the driver. Oh and they are stopping all drives with no probable cause.
While I, as am an immigrant and pp you're responding to, absolutely hate this, of course. It's important to distinguish what is legal and what is not. If DC MPD stops you during those check points it is absolutely legal for them to ask for your ID, registration and proof of insurance. You could be and probably will be arrested if you do not provide that regardless of your immigration status. I'm not sure what authority ICE has for establishing those check points or asking for information, but I would love if a lawyer who actually knows what jurisdicion they have would chime in and let us know.
