On the civil side you have to consent for trial before magistrates and the evidentiary rulings are all then reviewed by the article iii judge (although very deferentially). [/quote] Depends on the court but I clerked for a magistrate judge and he handled a lot of criminal matters including some high profile ones. I can’t remember what the dividing line was because I handled his civil docket and it was years ago. Zia is a nice, reasonable guy.[/quote]
