Yeah, he looks solid.  But what does a magistrate actually do in a criminal mattter?  Is he likely to make evidentiary rulings, preside over the jury trial, or make the sentencing decision?  I just don’t know what the division of duties in on the criminal side.  On the civil side you have to consent for trial before magistrates and the evidentiary rulings are all then reviewed by the article iii judge (although very deferentially).  [/quote]

Depends on the court but I clerked for a magistrate judge and he handled a lot of criminal matters including some high profile ones. I can’t remember what the dividing line was because I handled his civil docket and it was years ago.
