Sportsbooks and online casinos have, for many years, been relying on presumably similar methods for correctly identifying the state where someone is located (and preventing the use of VPNs to disguise that), and I haven't heard of any lawsuits successfully challenging them on this.[/quote] There is nothing in the Constitution explicitly protecting gambling. Porn is protected by the First Amendment. Obscenity is not, of course, but porn is. It could be framed as a free speech issue. [/quote] The conservatives on SCOTUS do not agree with you.
