It would be ill advised to shift the partisan makeup to have, for example 2 independents, because any Republican who applied but was not selected would almost certainly have standing to sue over the process. As of now, the only person who has an obvious claim to standing is Elrich, because he’s been cut out of a process in which he has a statutory role. Maybe he’s decided to play dead on this and let the council keep digging its own hole but I wouldn’t be surprised to see him weigh in after selections when it will be harder for the council to fix its missteps.
