If they have an ITIN, employers are supposed to follow the Form I-9 process. [/quote] No. They file the paperwork upon employment. The employer is not allowed to challenge it. They they put down 17 dependents on their W-4. It takes the IRS time to track that down. By the time red flags go off, they're long gone to the next employer after putting down a fake address and cashing pay checks, tax free because of the false withholding information.[/quote]
