| Are you hurt or are you just looking to recover for damages to the car? If you are hurt, most personal injury lawyers do not require up front payment. If it is just damage to your car, you should be able to handle it yourself with their insurance company. If the truck was not insured or if the truck driver is disputing fault, then you might want a lawyer. I don't have one to recommend, but you will get better responses here if you give a little more information. |
Seems like their insurance is bouncing me off from one agent to another from one email to another, from one organization name to another, thus i was thinking to get someone knowledgeable to talk about how to work it through. I am assuming they will obviously want to get their fault minimized with this type of treatment so far. Its been weeks and I still can't get a hold of anyone from insurance company.

| I would deal with my insurance company in this case. Your insurance company will get you your money and repair your car. It doesn't lead to an increase in premiums. |
| Make sure to request payment for the loss of value for your repaired vehicle. It is separate from the cost to repair. It is compensation for the lowered value of your vehicle since it has an accident on the record. You have to request it from his insurance and can haggle for more than their initial offer. |

If you have bodily injury and property damage, I would get an attorney. Reason is this. If they were to actually get resolution from their carrier on the property damage, the releases often state that all claims are resolved. If you inadvertently sign something like that, you are out of luck on your personal injury claim.
Here's the thing though. An attorney is going to charge you 1/3 of the recovery. So, for the vehicle damage, I agree with the others that I would go through your insurance. One last thing. Stop waiting around. If someone backed into you, it's just as likely they will claim you rearended them. Time is not your friend when it comes to evidence. Any video evidence is likely saved for a very limited time (thing Ring doorbells, business videos, etc.). Waiting around is just going to make your case very difficult to prove. Most attorneys work on contingency and you pay expenses. They may advance costs, but in the end, win or lose, you are responsible. |

Figure out how much you will gwt for bodily injury. After 1/3 out and full tab on any medical expenses it may not be worth it to you. I got a $15k judgement in favor. Attorney took $5k. Physical therapy company and medical took $7k!!!!
Even though I had initially paid only copays. They attached to the claim. I got $3k! Just calculating that for you to drive home the point that in the end it may not be worth your time (lots of it). |
That's the things, without lawyers the dont give you half of what you claim, they will brush you off knowing you dont know any better to advocate for yourself.
