Facing lawsuit over restrictions on Christmas services, D.C. mayor eases coronavirus rules

Facing a federal lawsuit from the Archdiocese of Washington over rules prohibiting large gatherings — including Christmas services — during the coronavirus pandemic, D.C. Mayor Muriel E. Bowser issued a late-night order Wednesday modifying the city’s rules on worship services and other activities.

Bowser (D) revoked the cap of 50 people that she had previously imposed on worship services and instead ordered that religious facilities fill no more than 25 percent of their pews, up to a maximum of 250 people at one event, no matter how large the venue.

The order took effect at 12:01 a.m. Thursday, as the District, Maryland and Virginia continue to see spiking levels of coronavirus cases and hospitalizations.

It cites the archdiocese’s lawsuit — which was filed last Friday and includes a motion for a temporary restraining order filed Monday



Bowser did this because the Republicans on the Supreme Court issued a ruling on churches in NY State. That ruling was based on distortions - and even outright fabrications.

But Republican attorneys are gonna Republican-attorney -- they're going to get to the decision they want (in this case the Christian-identity-politics decision they want) no matter what helps the country or fits the law.


If your grandma dies of COVID in DC, remember that the Republican Supreme Court forced Bowser's hand and made her remove restrictions on church gatherings.

Sotomayor, the nation's only Latina Supreme Court Justice and a native New Yorker, was not having it.

“Free religious exercise is one of our most treasured and jealously guarded constitutional rights. States may not discriminate against religious institutions, even when faced with a crisis as deadly as this one,” she wrote. “But those restrictions are not at stake today.”

In her dissent, in which she was joined by Justice Elena Kagan, she wrote: “Justices of this Court play a deadly game in second guessing the expert judgment of health officials about the environments in which a contagious virus, now infecting a million Americans each week, spreads most easily.” The Court had rejected challenges to similar measures in California and Nevada earlier this year, and she saw no reason for its apparent change of heart. The Court’s ruling, she noted, “will only exacerbate the Nation’s suffering.”




In her dissent in the Covid-19 restrictions case, Roman Catholic Diocese of Brooklyn v. Andrew M. Cuomo, Sotomayor took aim at Gorsuch’s comparison of New York’s treatment of religious institutions to liquor stores and bike shops. In the latter venues, she reasoned, people do not gather inside for more than an hour to sing and speak to one another.


Gorsuch knew what the science was -- it was covered in briefing in the case.

But he chose to ignore that difference, to distort the truth, in order to get to the decision he wanted to.

This is on the church and the individual. My church is completely closed for in person services at this time. Don’t blame this on republicans / Christians. The responsible ones I know aren’t going to services.
