ROMAN CATHOLIC DIOCESE v. CUOMO

For lawyers on the board, can the analysis in the SCOTUS decision applied in the Roman Catholic diocese case also be applied to school closures?

No. The church challenged the regulation. Schools are electing to stay closed.

Not a lawyer, but I think it would only be applicable if a state government tried to shut down religious schools while leaving secular ones open. I haven’t seen that happening anywhere.

A federal judge just struck down a portion of Kentucky Gov.'s executive order requiring private as well as public schools to halt in-person classes until early January. The judge said the order cannot apply to private, religious-based schools across the state because it infringes on their constitutional rights.

Maybe to religious schools. But not public schools/secular privates. It was a first amendment case.
