IEP and homeschooling

I am considering homeschooling for the coming academic year. DD has an IEP and I assume would get no services if I homeschool. However my question is - if we went back to public school in the 2021-22 school year - would we have to be re-evaluated for the IEP or would we automatically still get services? I'm afraid we would have to fight to get it again which make me reluctant to pull her out of public. Thanks for any advice.

Depends on your state/DC. You'll need to check. Most jurisdictions do not require services for homeschooled kids.

It used to be illegal in some states to homeschool kids with certain disability categories, such as "mental retardation" (the IDEA term) but those restrictions collapsed when challenged is my understanding.

Sorry, misunderstood your question. As long as it's not after the time period for re-evaluation requirements, you should be able to return with special ed status. We did it.
