Do Babies Count for HOV?

Husband and I will be traveling tomorrow afternoon with 13 week old baby and we'd like to drive in HOV-3. Does baby count in the car seat?

I thought babies didn't count because they wouldn't otherwise be able to transport themselves so really they're not taking another car off the road. Isn't that the point of HOV lanes...to get people to car pool?

I got pulled over on the Dulles Toll Road with my 9 month old in the car. The officer gave me a ticket and I had to go to court and fight it because he did not know the law. So no there are no dumb questions
