Hello:
My child recently completed a comprehensive neuropsych evaluation at our private expense. We would like the written report, which we are awaiting, to form the basis for my child’s eligibility review meeting. (Current eligibility expires on June 8.) Since we’re awaiting the report, how much time is DCPS legally entitled to for review of the neuropsych? DCPS is presently giving March 27 as a deadline to receive the report. If the private neuropsych is not ready until a bit later, can DCPS refuse consideration of it at an eligibility meeting? Can someone point me to appropriate written regulations? Thanks. |
| DCPS has 30 days to review any reports you submit. |
| Given that DCPS has an obligation to perform an evaluation before June 8th, if they determine that the report you submitted doesn't have the info they need, then it's reasonable of them to ask for time between the end of the 30 day review period, and June 8th. Otherwise, if they finish reviewing the document in late May, and discover that there is insufficient info to make a determination, they are in a difficult position. |
Is this written down somewhere? |

1) Is this an IEE report or one you sought on your own?
2) This document is a bit legalistic but lays out timelines and so forth https://osse.dc.gov/sites/default/files/dc/sites/osse/publication/attachments/Part%20B%20Procedural%20Safeguards%20Update_%20August%202018-ENG.pdf |
