"There were a number of factors leading up to the crash, not just Atakoglu's speeding, Felsen said. One of those factors concern “how the other vehicle was being driven,” he said."

I haven't read all pages so forgive my ignorance but was the road such that the speeding car not visible by that WW school family driver? Why did he or she make that left turn?

The dude was going 115 mph. That's really all you need to know. It doesn't matter how good the visibility is. You won't see much going that fast. And no other motorist is going to be able to see that car, either.

The family was turning left to attend a play at the school. Horrific. The dude collided with them as they made the turn.

It's the same attorney who said immediately after the crash that Atakoglu was driving appropriately and not speeding. And it's the same attorney who has gotten off of every other reckless driving and speeding charge since he got his license. I don't know how he can live with himself.

The Car was going 115 mph.
Yes the left Turing car saw the speeding car, but would not have anticipated it going 70 mph OVER the speed limit. That is insane. The left turning driver was making judgments based on how quickly a car moving no more than 10-15 mph over the speed limit would be traveling.

The family in the left turning car was murdered.

Yes the left Turing car saw the speeding car, but would not have anticipated it going 70 mph OVER the speed limit. That is insane. The left turning driver was making judgments based on how quickly a car moving no more than 10-15 mph over the speed limit would be traveling.

The family in the left turning car was murdered.

Agreed. Knowing the facts it seems like murder to me - not just a mere accident.

Nonetheless, the driver in the left turning car needs to give way. The speeding car had right of way regardless. Maryland recognizes contributory negligence.

And under these circumstances, their contribution was like .0000000001%. Moreover, this isn't a case of two parties being negligent. The BMW's extreme recklessness and disregard for human life trumps whatever negligence there may have been by the other driver.
