I am not a lawyer and I have no idea about some of the legal arguments above. Ever since Gore v Bush, I have lost all faith in this court. They go hunting with Cheney, then rule in his favor. Thomas' wife shill for the tea party on health care, so guess where Thomas lands. They consistently vote for money, corporations, republicans, etc. over individual rights. They just seem like a bunch of rich guys protecting their fellow elites to me. Maybe they have some consistent logical argument about it all, but I submit that the point of the argument is to protect certain interests.
As for Scalia, he is a very pompous individual. This mistake is one I have never heard any other justice being accused of making, so the excuses don't move me. In my world if you sign your name, then you are accountable. For example, if I sign some credit card contract that requires a magnifying glass to read, do you think Scalia will give me a break in my law suit just because I work long hours, have kids, and the print is small. Not a chance. Ultimately, this won't change much, but it is nice to see the guy who thinks he is the smartest person in the room get cut down by a pretty stupid mistake. Fortunately, he is one of the few people that don't have a boss and can never be held accountable for dumb things. |
