Question for attorneys – moving out of state

Well, sort of. I'm currently in PG County, as well as my ex. My son goes to school in PG County. I'm moving the Fairfax County, and would like to get my child into a good public school system. Currently, my ex appears to be agreeable, but that fluctuates with the weather. With Me moving to Virginia, am i violating any laws, or jeopardizing my custody? I know that there are laws regarding moving out of state, but seriously, we're talking about around the beltway. Any advice would be appreciated.

Not an attorney, but a family member went through something similar. Family lived in fairfax, parents split up, mom wanted to move back home to Maryland. The law is that the kids stay where they were originally so she couldn't take them to Maryland with her. She was able to move MD legally but lost custody of them. Whatever you decide to do, get a legal agreement with your ex first. Taking the kids across state lines without one is definitely a no-no.

Check your custody agreement. Mine just says we have to give each other 30 days notice in advance of any planned move.

The law is state by state, and OPs ability to move will largely depend on her divorce agreement, and whether the current custody arrangement can be maintained after a move.
