Damages in Baldonis claims against the Lively side, including the NYT. He was defamed by them and suffered harm, including but not limited to being dumped by his agency

the basis identified in the motion--fair report privilege, the only identified defamatory statement ("smear campaign") is opinion. There's a high bar to state a defamation claim by a public figure and the complaint against the times aint it. It was filed just to get the counter narrative out there ASAP and on that basis it was a success. As a legal claim against the NYT not so much (I doubt they care much)

Unfortunately the NYT lost their best defense- FR- by making the article read more like a metoo expose, bringing in Flaa and also alleging they’d gone through hundreds of text messages etc.

But doesn't what Ari said actually negate that? Ari makes it sound like he barely knew who Baldoni was before all this, not like a valued client. It sounds like Ari would have taken Lively/Reynolds side regardless.

Is his opinion the same in terms of impact on Baldoni’s career as yours? Is this really so confusing?

His “opinion” was a public brag about firing Baldoni as a client and when the seeming public sentiment was still acidic towards BL and RR, all of a sudden for the first time ever in the history of an extremely popular and successful podcast, the episode with him doing this disappears. Maybe losing representation and having awards taken away and having productions kick him out are of a piece?
