Maybe the distinction is that the call(s) were between Cohen and the actual WH (Trump in his president capacity) vs between Cohen and Trump privately, in his "personal" capacity? |

This was vetted by supervisors at the U.S. Attorney’s Office, specialized lawyers at the Justice Department, and by a Deputy Assistant Attorney General, and a judge. Given who Cohen is, it’s hard to believe Rosenstein was not consulted as well.

Why is this a surprise? It was almost certain that Cohen was being electronically surveillance and the intercepted communications provided the predicate for the warrants executed on his home, hotel, office and safe deposit box. I also seem to remember reporting that the FBI has been given a warrant for Cohen’s email accounts, and this is the same warrant. I’d love to see that probable cause affidavit. |

I don't dispute he's an idiot, but presumably after the raid Cohen would have known he was being surveilled in some capacity, and avoiding discussing things over the phone. That said, I could see Trump pulling a "Stay strong, Michael" without Cohen being able to stop him. |

They've reported that the call was between Cohen and a number at the White House. BUT they haven't said who at the WH that number belongs to - don't assume it's the President.
