| I bought something on craigslist and I'm not satisfied with it. The item was posted as used and nothing was said about return policy. I asked for my money back and the seller refused. Can I have my money back? Is there any legal action I can take? Am I entitled to return the product for a full refund? Thanks. |
| Is there something wrong with the item or is it not as advertised? |
| There are no guarantees or implied warranties when you buy from a private individual. Moreover, you indicate you are "not satisfied." That doesn't sound like a reason for legal action. |
| OP here: There is something wrong with it. Aesthetically speaking, but it works just fine. DH saw it and bought it, but when I saw it, I didn't like it. |

Okay, so the situation is:
Your husband purchased something on Craigslist. That items functions fully for the purpose for which it was represented. You didn't buy it. You don't like for an aesthetic reason. You want your husband to get his money back. I don't see any reason that you would be entitled to a refund. You weren't defrauded in any way. Frankly, you sound like a total PITA. |
| I am guessing it would be an "as is" buy since it was on Craigslist and not subject to any conditions like your approval. So I'm not sure what theory you would be entitled to recover your money. |
| Craigslist isn't like Ebay or Amazon. There's no such thing as a return policy. Sorry you had to find out the way you did. |
| OP here: I talked to the person who was selling it and specifically asked a few questions and looking at the item I can tell that what was told was not true. Can I file a small claims report? |
|
Do you think if the exact same thing happened at a garage sale that you could return the item for a refund? No way.
Same thing applies here. Craigslist is just a big online garage sale. |
The short answer is no. Is it worth it? How much did you spend? Can't you just re-list it? |
No way. Your husband saw it before he bought it. He bought it 'as is' which he SAW and presumably liked before he paid. It's not as if it was shipped to you after seeing a picture online. It is like a garage sale. There are no returns. However, if you continue to pester them they may fear for their safety and give you your money back just to protect their family from a nut case.... |
But this was after your husband bought the item so it's not a misrepresentation which induced the sale. |
| OP, since you haven't told us what this item is...unless the seller told you it was a Van Gogh and it is not, the answer is no. |

Did you buy my stroller, LOL?! Seriously, I had a lady who sent her husband to pick up my Peg stroller (for the high price of $50...) and she got all snarky on the phone with me saying she thought there was too much wear on the tires, blah blah blah, and practically worked herself into tears/ hysteria on the phone.
To shut her up and because she knew where I lived, I told her to calm down and bring it back. I sold it later to a sane person. OP: you will look ridiculous trying to fight this in small claims court. If the seller didn't laugh when you asked for a refund, she was being polite. Your husband bought it, so it passed his sniff test, so I don't see where you could really say you're entitled to a refund. Craigslist = Garage Sale Craigslist =/= Amazon.com, Nordstroms If you don't like it, list it yourself on Craigslist or donate it. My $0.02 worth. |

id you buy MY travel system?? Same thing happened to e too. Graco travel system. After the husband said it looked great she called me a zillion times (including at 11pm) and asked for her money back. She said I STOLE the money from her and that she would report me to CL. Boy, I'd love to read that complaint. |
