Talk to the attorney. It will vary based on the state, as well.
I assume that Mom has Dad as POA. and Dad has Mom as POA. Unless they told you that you are the POA. |
How sick is your parent? if they are coherent, they can sign the POA paperwork and it will be valid.
I work in an office where one of our client's mother was quite ill, but still with it enough to understand what she was signing so it wasn't a problem. This was in Maryland. |
