This sounds like assault to me. What does it sound like to you? A teenage boy was charged as a juvenile with assault after Baltimore County police said he kissed a classmate against her will. A 14-year-old girl, an eighth-grader at Pikesville Middle School, told police Wednesday that a 13-year-old boy grabbed her by her shirt, pulled her toward him and "open-mouth kissed her with his tongue," according to police. The girl said she was kissed against her will. The boy, who also is in the eighth grade, told police that he had been dared to do it. The boy was charged as a juvenile and released to his mother. | Do I think he needs a criminal juvenile record so for his lifetime he has to answer yes, he has been charged with a crime, whenever he fills out a job application, even 30 years from now? No. And yes, I have a daughter. |

Sounds like an assault to me, too. As an adult, I wouldn't want anyone doing that to me. I hate that it happened to a 14 year old child.
13 is old enough to understand what unwanted sexual touching is. This boy's parents failed to get that across. |

I'm an attorney and previously taught criminal law and procedure. I'm pretty sure I do. Do you? In the links above for the job applications, unless the kid lies, he'd have to say yes he had been charged with a crime. |
I'll add that YOU are the one confused. You're thinking that the juvenile record will be sealed. That's different for asking the person directly if he has been charged with a crime. |

I didn't say that. I think there are two ways to look at this. One way is he did the crime, so he needs to face the full punishment. The other is that it could be handled on a school level (suspension) and have school wide education on the topic, and the message is still received by him. Do you think this kid won't have learned his lesson by a week's suspension, his parents knowing, the school knowing, etc? Do you think the boys who made the dare with him aren't scared themselves? Do you think he needs a record as a deterrent for future similar behavior or that the remainder if the student body needs his punishment to deter them from acting like this? |

Chicken and egg, right? I mean it was an unwanted sexual touching of another...it is assault. If it is assault, then he should be charged, right? I don't object to it being called an assault, because it is what is it. I don't like to see a life marred so young by something that was clearly stupid and the lesson doesn't need to be taught to him by handing down a lifelong punishment. |
