Former consular officer again: if you want your nephew to come to the US and enroll in public school, he would need an F student visa (yes, even for public secondary school) and pay tuition (yes, even for public secondary school). Our public schools can permit foreign students to enroll provided they stay less than 12 months and pay the education costs.

Okay, are you saying that it’s legit if OP becomes the legal guardian of her nephew and he can attend school? And if OP doesn’t become his legal guardian he needs to get an F-1 visa and pay tuition?
