Who is at fault in this car accident?

The fact that OP doesn't know they're at fault is proof so, sooooo many people shouldn't be allowed to drive. You hit someone from behind it's always your fault. Period. No excuses, even if they slam in their brakes you should have enough space to brake if you drive correctly.

Next time, don't tailgate OP. Go back to driving school.

The fact that OP had no idea AND the person OP hit was going to accept blame for being rear ended explains a lot with the way people drive. JFC

If you rear-end a car that is backing out of a parking spot or a driveway, is it still your fault?

We are in CA and this happened to my DH. It's strict liability--you are at fault. We tried to argue that it was really two accidents...the first two cars hit and stopped, and DH in the third car slid into and barely tapped the second car. It's BS so I say try and fight it but we got nowhere. (but that was over 10 years ago now, so maybe something has changed)

If you rear-end a car that is backing out of a parking spot or a driveway, is it still your fault?


No because they must yield to someone in the travel lane.

Ugh, sorry, I agree that it was your fault, but how annoying that they stopped. We have a lot of roundabouts and many people don’t know how to use them at all. It’s equally bad when someone stops IN the roundabout because they think they have to yield to a car that is waiting to enter.
