Does a divorce decree supercede a separation agreement in Virginia?

My ex and I entered into a separation agreement in April even though I left our home in December. Many of the provisions of the agreement are being used to my detriment as I unknowingly signed the document. I understand that it was my fault for not doing things more carefully. However; if I file for divorce, will that decree void the separation agreement? We do have 2 minor children.

What does your lawyer say and why did she allow you to sign it?

My husband divorced in Virginia. The child custody and support provisions in the separation agreement were adopted as part of the divorce decree. You could choose to do it differently. You can also file for a modification of tge current separation agreement. You really need a lawyer.

How did you unknowingly sign a document? Someone moved your hand in your sleep?

Don't play a helpless victim. You signed a document. If you didn't read it or get legal advice to understand it - that is your choice. Be responsible for your decisions and do what you need to do to change them.
