Layoffs while on FMLA maternity leave

Anonymous
It's possible my company may be announcing layoffs of some of the staff later today. I am out on FMLA maternity leave.

Can my company lay me off while I am out? If I am laid off, what should my next step be (other than sending out resumes)?

How long are they legally required to keep my position for me after returning?

If they are laying off, for example, all bricklayers, and you happen to be a bricklayer, of course they can lay you off. The fact that you are on FMLA does not make any difference. You are not being laid off because you are on FMLA.

If however you are being singled out for layoff, that is another story.

More details please.

I was laid off while out on maternity leave. I literally got the letter the day I got back from the hospital. Yes, it can happen.

It happened to a good friend of mine, and the above was the legal advice she was given.

Good luck OP!
