I'm not sure that the Democratic Party is above using the law to their advantage. President Biden does not have to execute his opponent, but he can decide that Mr. Trump is too much of a threat to the American public and that he should be detained for questioning. He can have the military arrest Trump and hold him in Guantanamo Bay or similar to have him interrogated about the January 6 coup attempt, at least for a few months. Once the election has passed, President Biden could be satisfied that Mr. Trump is no longer a threat to the American public and release him.
And he would have immunity as granted by the SCOTUS.
